Hawkins & Nicholls’ Successful Bodily Injury Claim Defense Upheld in Court of Appeal

In a 2-1 majority decision, the BC Court of Appeal upheld the trial judgment in a case in which Tom Hawkins and Megan Nicholls successfully defended a significant bodily injury claim on the Plaintiff’s lack of credibility. The majority of the Court of Appeal in Zajaczkowski v. Grauer, 2016 BCCA 48 confirmed the findings of the trial judge that the Plaintiff’s evidence was not credible, reducing the claim from $4,000,000 to $53,000.
